These terms and conditions (“Terms”) apply to anyone who uses this website, and to anyone who books video production or content services with Visual Punch (“we”, “us”, “our”). Visual Punch is a trading name operated by James (full legal name available on request), a sole trader based in the North East of England. By using this website, requesting a quote, or booking a project with us, you agree to these Terms.

For any specific project, the quote or proposal we send you sets out the deliverables, price, and timeline for that job. Where anything in a signed proposal conflicts with these Terms, the signed proposal takes priority.

1. Quotes, Bookings & Payment

Quotes are valid for 30 days unless stated otherwise. A booking is confirmed once you’ve accepted a quote or proposal and, where required, paid any deposit requested. Unless otherwise agreed in writing:

  • A deposit may be required to secure a filming date.
  • The balance is invoiced on delivery of the final edit, or in the stages set out in your proposal.
  • Invoices are payable within 14 days of the invoice date.
  • Late payments may incur a reasonable admin charge and we reserve the right to pause further work, including delivery of final files, until overdue invoices are settled.
  • All prices are shown exclusive of VAT unless stated otherwise.

2. Cancellations & Rescheduling

We understand plans change. If you need to move or cancel a confirmed filming day:

  • More than 14 days’ notice: we’ll rearrange the date at no extra cost.
  • Between 7 and 14 days’ notice: a rescheduling fee may apply to cover time already allocated to your project.
  • Less than 7 days’ notice, or a no-show on the day: the deposit is non-refundable, as this time has been reserved exclusively for your project and turned other work away.

If we need to reschedule due to illness, equipment failure, weather (for outdoor shoots) or other circumstances outside our control, we’ll offer the next available date at no extra cost to you.

3. Filming Days & Your Responsibilities

To keep your project on schedule, you agree to:

  • Arrange access, permissions and any site inductions we need to film at your premises or a chosen location.
  • Make sure anyone appearing on camera has agreed to be filmed, and that you have the right to have them filmed as part of your project (for example, staff, customers or members of the public).
  • Provide any branding, scripts, logos or reference material we need in good time.
  • Respond to review requests and feedback within a reasonable time, so revision rounds and delivery dates aren’t delayed.

We’re not responsible for delays caused by late access, missing permissions, or slow turnaround on your side, and any resulting rescheduling may be chargeable.

4. Deliverables & Revisions

Your proposal will set out what’s included: the number of films, formats, and cutdowns. Unless your proposal says otherwise, each deliverable includes up to two rounds of revisions based on feedback given in one consolidated set of notes. Additional rounds, or changes outside the original brief (new footage, a different structure, additional edits) may be quoted separately.

5. Ownership & Usage Rights

Visual Punch owns the copyright in all raw footage, project files and unused material from a shoot. Once a project is paid in full, you’re granted a licence to use the final, delivered edit(s) for your own marketing and business purposes, in the formats agreed in your proposal.

Unless you tell us otherwise in writing before or at the point of delivery, we may also use the finished film, project stills, and a written case study describing the work (including outcomes and results) in our own portfolio, website, social channels and pitches to other prospective clients. If you’d rather we didn’t, just let us know and we’ll respect that.

Raw or unedited footage is not included in the licence unless it’s specifically agreed and quoted for in your proposal.

6. Third-Party & Client-Supplied Material

If you supply us with logos, music, images, footage or other material to include in your project, you confirm that you have the right to use it and to let us use it on your behalf. You agree to cover us for any claim that arises from material you’ve supplied.

7. Confidentiality

We treat information you share with us about your business as confidential, and won’t share it outside of what’s needed to deliver your project, except where we’re legally required to.

8. Liability

We’ll deliver your project with reasonable care and skill. Our liability for any claim arising from a project is limited to the amount you’ve paid us for that project. We’re not liable for indirect or consequential losses, such as loss of profit or business opportunity. Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for anything else that can’t legally be limited or excluded.

9. Force Majeure

Neither party is liable for delay or failure to perform caused by events outside their reasonable control, including extreme weather, illness, industrial action, or changes in law.

10. Use Of This Website

The content on this website (text, images, film, branding) belongs to Visual Punch or is used with permission, and shouldn’t be copied or reused without asking us first. We’ve taken reasonable care to keep the site accurate and up to date, but we don’t guarantee it’s error-free, and we’re not liable for any loss arising from your use of it. 11. Governing Law

These Terms are governed by the laws of England and Wales, and any disputes will be dealt with in the courts of England and Wales.

12. Changes To These Terms

We may update these Terms from time to time. The version on this page at the time you book a project is the version that applies to that project.
